• StarNode Studios, LLC Products utilize blockchain technology and complex software systems that may contain undiscovered vulnerabilities, bugs, or weaknesses

• Such technical issues may result in complete or partial loss of functionality, access, or value

• No guarantee of continuous, uninterrupted, or secure access to StarNode Studios, LLC Products

b) Smart Contract Risks

• Smart contracts may contain coding errors, logic flaws, or other defects

• Execution of smart contracts may produce unintended or adverse results

• Smart contract interactions are automatic and irreversible once initiated

c) Security Risks

• Digital assets and accounts may be subject to unauthorized access

• Private keys and wallet credentials must be securely maintained by users

• No recovery mechanism for lost access credentials

• Potential vulnerability to various forms of cyber attacks

3.2. Regulatory and Legal Risks

a) Regulatory Framework

• Blockchain technology and digital collectibles operate in an evolving regulatory landscape

• Users are solely responsible for determining whether their use of StarNode Studios, LLC Products complies with applicable laws

• StarNode Studios, LLC Products may become restricted or prohibited in certain jurisdictions

• Users must comply with all applicable laws, including but not limited to securities, tax, and consumer protection regulations

3.3. Market and Economic Risks

a) Valuation Volatility

• The value of StarNode Studios, LLC digital collectibles is inherently speculative

• No guaranteed minimum or maximum value

• Potential for complete loss of value

• Market prices may be manipulated by third parties

• Historical performance does not indicate future results

b) Liquidity Risks

• No guarantee of secondary market trading

• Ability to sell or transfer may be limited or impossible

• Potential lack of buyers or trading venues

• Trading volumes may be insufficient to support desired transaction size

a) ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES b) LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES c) DAMAGES FOR BUSINESS INTERRUPTION d) DAMAGES RELATED TO ACCESS OR USE OF STARNODE STUDIOS, LLC PRODUCTS

6.2. Monetary Cap

STARNODE STUDIOS, LLC'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THIS NOTICE OR STARNODE STUDIOS, LLC PRODUCTS SHALL NOT EXCEED THE LESSER OF:

a) The total amount paid by the user directly to StarNode Studios, LLC for products or services in the six (6) months immediately preceding the claim; or b) Five hundred United States dollars (US$500.00)

7. DISPUTE RESOLUTION

7.1. Mandatory Arbitration

ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THIS NOTICE OR STARNODE STUDIOS, LLC PRODUCTS SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION:

a) Administered by [Specified Arbitration Organization] b) Conducted in accordance with [Specified Arbitration Rules] c) Held in [Specified Location] d) Conducted in the English language e) Before a single arbitrator

7.2. Class Action Waiver

YOU AND STARNODE STUDIOS, LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS:

a) A plaintiff or class member in any purported class action b) Collective proceeding c) Private attorney general action d) Other representative proceeding

7.3. Governing Law

This Notice shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law principles.

8. AMENDMENTS AND MODIFICATIONS

8.1. Right to Modify

StarNode Studios, LLC reserves the right, at its sole discretion, to modify, amend, or replace this Notice at any time. Material changes will be communicated through:

a) Email notification to registered users b) Prominent notice on the StarNode Studios, LLC website c) Update to the "Last Updated" date at the beginning of this Notice

8.2. Continued Use

Your continued use of StarNode Studios, LLC Products following any modification of this Notice constitutes your acceptance of the modified terms and conditions.

9. ACKNOWLEDGMENT

BY USING STARNODE STUDIOS, LLC PRODUCTS, YOU ACKNOWLEDGE THAT:

a) You have read and understood this Notice in its entirety b) You have the necessary legal capacity to agree to this Notice c) You assume all risks associated with using StarNode Studios, LLC Products d) You accept that StarNode Studios, LLC Products are non-financial, non-investment digital collectibles designed solely for entertainment and artistic purposes e) You will comply with all applicable laws and regulations

This Notice represents the entire understanding between you and StarNode Studios, LLC regarding the matters contained herein and supersedes all prior agreements and understandings, whether written or oral.
